Replacing the minimum duration of annual leave with financial compensation will be prohibited in Azerbaijan
The prohibition on replacing the minimum duration of annual leave (21 calendar days) with financial compensation is envisaged in the proposed amendments to the Labor Code—corresponding revisions are proposed to be introduced to the Labor Code, 1news.az reports, citing APA.
According to the draft law, with the exception of the case provided for in Part 2 of Article 144 of the Labor Code (payment of compensation upon termination of employment relations), it is proposed to prohibit the replacement of the minimum duration of annual leave—21 calendar days, established by Part 2 of Article 114 of the Code—with financial compensation.
Additionally, the bill clarifies the concept of postponing annual leave or a part of it to another period, and more thoroughly and clearly defines the cases in which such a postponement is permitted.
As part of the project, corresponding amendments will also be introduced to other sectoral laws regulating this right.
